Sunsetter Pools Terms & Conditions
QUOTATIONS
Once the quotation document is signed on behalf of a company, a Director’s Personal Guarantee is required. The ownership of the goods remain vested in Sunsetter Pools until the entire purchase price has been fully paid and credited to the Sunsetter Pool’s account. Sunsetter Pools may enter the premises of the client and remove the goods supplied by the Sunsetter Pools (or contractors of) for which payment has not been made in full.
This quotation is held fixed for a period of 30 days, after which accumulative materials and labour price increase may effect this offer.
PRELIMINARY AGREEMENT
CUSTOMER’S OBLIGATIONS
Unless otherwise agreed upon in writing the customer is responsible for the following
- Compliance of site with any water restriction requirements
- Swimming Pool &/or Spa Fence requirements
- Disposal site of excavated materials
- Any other statutory requirements
COPYRIGHT
The Builder owns the copyright and intellectual property in any and all plans, instructions, specifications, computations, drawings and any other document or documents created by the Builder for the purpose of completing the Preliminary Works, until the Date of Completion, when ownership of the copyright and intellectual property in these documents will pass to the Customer; and the Customer is not granted a licence or permission to use any documents in which the Builder owns copyright, in connection with this Site or elsewhere, without the Builder’s written consent.
All images taken by Sunsetter Pools may be used for marketing &/or advertising purposes unless written instructions have been received prior.
DISPUTE RESOLUTION
Disputes between the Customer and the Builder arising under or in connection with this Preliminary Agreement may be referred to a mutually agreed third party, whose role will be to assist in the resolution of the dispute in the first instance. If the dispute cannot be resolved through such negotiation or mediation, either party must then give a written notice to the other parties advising that they intend to resolve the matter through other legal means as appropriate.
PAYMENTS
“In the event where your overdue account is referred to a collection agency and/or law firm, you will be liable for all costs which would be incurred as if the debt is collected in full, including commission on collection of the additional costs and also including legal demand costs”.
All payments must be made in accordance with the Contract Terms.
The Customer must pay the Deposit as per the Contract Terms in order for preliminary Works to begin. The Customer must pay the Contract Price progressively on completion of the Works and at each stage.
Changes to the Contract Price:
The Contract Price is subject to change as a result of:
a) The actual cost of the prime cost items and work for which provisional sums have been specified exceeding the estimates set out in the contract.
b) Variations including those required by the council/registered building surveyor
c) Interest on overdue payments
d) Extra costs for delay claimed by the builder
The signed Contract includes any schedules and annexures, which constitute or evidence the final and concluded agreement between the Customer and the Builder concerning the execution of Works.

RETURNS AND REFUNDS
Sunsetter Pools handles returns and processes refunds in accordance with the Australian Consumer Protection legislation.
Should you wish to return your order, please notify us within 14 days of purchase with a valid reason for return. If we are unable to resolve your complaint or further assist you, we will process a refund upon timely receipt of the goods purchased. Unopened goods will be refunded in full. Refunds will be processed promptly and payment made by the same method that you made payment. All refunds are made at the discretion of Sunsetter Pools.
Refunds can not be issued for any virtual products, software, hosting or services rendered.
